So Far Museveni 3:0 Bobi Wine in Presidential Election Petition

As things stand in the presidential elections petition, one would be right to say President Yoweri Museveni is so far leading the petitioner, Robert Ssentamu Kyagulanyi alias Bobi Wine by [3:0] three goals to nil.

Bobi Wine rushed to Uganda’s Supreme Court to quash Museveni’s victory of January 14 elections. The Electoral Commission announced Museveni winner with 58 percent will Bobi Wine scored 35percent.

On February 1, Bobi Wine filed a petition which is expected to be decided next month on 18th. However, Bobi Wine has attempted three times to file additional evidential affidavits which he believes are crucial during the hearing but in vain.

Today Bobi Wine was humbled again when eight out of nine [8:1] judges of the Supreme Court dismissed an application to file new evidence to back up his petition. It was only Justice Dr Esther Kisakye, who had dissenting views.

In a ruling that was read by Justice Percy Night Tuhaise, judges indicated that they had given due consideration to the application and submission of counsel for the applicant and for the respondent, by a majority of 8:1thus disallowing Bobi Wine’s application.

Bobi Wine was last week barred from filing 200 affidavits in the Supreme Court on grounds that he was out of time. It should be remembered that Supreme Court set February 14, as final day for surrender evidence.

The petitioner’s legal team led by Medard Lubega Sseggona, argued that the behaviour of the government abducting Bobi Wine’s supporters, bribing of their witnesses and a siege at National Unity Platform headquarters at Kamwokya hampered their efforts to file affidavits in scheduled time.

Chief Justice, Alfonse Owiny Dollo, used the delivery of the ruling on application to file more 200 affidavits to respond to Bobi Wine who a few days ago demanded that him and two other judges should recuse from his case citing conflict of interest.

Bobi Wine indicated that Justice Dollo defended Museveni in the 2006 case where Dr Kizza Besigye accused him of rigging votes and other election malpractices. Justice Mike Chibita, according to Bobi Wine should also disqualify himself because he was a Principal Private Secretary for Museveni for over 7 years.

Dollo warned Bobi Wine that he might soon crush if he does not control the speed at which he is probably moving. Dollo assured Bobi Wine that the ruling will be based on substantive evidence but not threats.
